This is with
reference to your letter regarding
claim of the subject shipment.
In this regard
and with immense regret, we would like to inform you that the subject shipment
was lost due to some operational impediments beyond our
control.
We would further
like to inform you that to make up for any loss or damage we have a “CUSTOMER VOLUNTARY INSURANCE SCHEME”,
which is available at a normal charge of 1% only of the declared value of the
consignment, which was not availed by you in this instance. Therefore, we would
like to advise you to please get all your future shipments booked under this
scheme to avoid any such occurrences in the future.
Further to this
we would also like to bring to your attention the Terms and Conditions of
Carriage laid down on reverse side of consignment note (CN) which was
considered as token of acceptance, becomes a contract of transportation between
the shipper and XYZ COMPANY (Carrier)
and does not permit us for any sort of compensation for consequential loss which is late delivery, loss or damage to a shipment whatsoever and our liability in such
cases is limited. Keeping in view the above mentioned facts, we are unable to
fulfill your demand of compensation.
We once again regret the
inconvenience caused to you. Nevertheless we look forward to your
continued patronage and assure you of
our best services, at all times.
